Terms of use of European Medical Jobs
General information
This document sets out the terms of service of the European Medical Jobs platform ("Platform", "we", "us").
By creating an account, accessing, or using the Platform, the user ("User", "Candidate", "Recruiter") agrees to these Terms of Service.
If you do not agree to these Terms, you must not use the Platform.
We may update these Terms from time to time; the date of the last update will be shown at the top of the page.
Definitions
For the purposes of these Terms, the following definitions apply:
- “Candidate”: any person who creates a profile, uploads a CV, or applies for jobs through the Platform.
- “Recruiter”: any individual or legal entity that creates an account to post jobs, search profiles, or contact candidates.
- “Account”: a registration created by a User on the Platform.
- “User Content”: information, text, images, CVs, job descriptions, and other data provided by Users.
- “Services”: features made available by the Platform, including profile creation, job posting, search, and contact between Candidates and Recruiters.
Eligibility and account creation
To create an Account, the User must:
- Be of legal age to enter into contracts in their country of residence.
- Provide truthful, complete, and up-to-date information.
- Keep login credentials confidential and not share them with third parties.
The User is responsible for all activities carried out through their Account.
The User must notify us immediately if they suspect unauthorized access or a security breach.
Services for candidates
The Platform allows the Candidate to, among other things:
- Create and update a professional profile.
- Upload, update, or remove CVs and other documents.
- Set job preferences and profile/CV visibility settings.
- Search and save jobs.
- Apply for jobs posted by Recruiters.
Profile and CV visibility
The Candidate may set profile and CV visibility using different options, such as:
- Public profile visible to registered Recruiters.
- Profile visible only to certain types of Recruiters (for example, paid accounts).
- Profile or CV hidden and visible only to the Candidate.
The Candidate may change these settings at any time in their Account preferences.
Despite visibility settings, we cannot prevent a Recruiter from copying or exporting data by their own means, and any further use is their sole responsibility.
Applications
When the Candidate applies for a job through the Platform:
- They authorize the sharing of their profile, CV, and relevant data with the Recruiter responsible for the job.
- They acknowledge that the final hiring decision belongs exclusively to the Recruiter.
- They agree that the Recruiter may contact them directly for recruitment process purposes.
Services for recruiters
The Platform allows the Recruiter to, among other things:
- Create and manage an organization account.
- Publish and edit job ads.
- Receive, manage, and review applications.
- Search Candidate profiles according to their visibility settings.
- Contact Candidates through the Platform tools when permitted by them.
Responsibility for job content
The Recruiter is fully responsible for:
- Ensuring that job postings are truthful, up to date, and not misleading.
- Ensuring that job postings comply with applicable law, including labor, immigration, professional regulation, and non-discrimination rules.
- Clearly describing duties, requirements, working conditions, and compensation where applicable.
The Platform may, but is not obliged to, review, moderate, or remove job postings it considers inappropriate, illegal, misleading, or contrary to these Terms.
User content
The User retains ownership of the rights to their User Content.
By uploading or submitting Content, the User grants the Platform a non-exclusive, worldwide license limited to what is necessary to operate the Services, to:
- Store, reproduce, and display the Content within the Platform.
- Process the Content for matching, job recommendations, and internal statistics.
- Share the Content with Recruiters or Candidates according to visibility settings and normal use of the Services.
The User represents that:
- They have all necessary rights to upload the Content.
- The Content is truthful, non-confidential, and does not infringe third-party rights, including copyright, privacy, or trade secrets.
Acceptable use
It is prohibited to use the Platform to:
- Provide false, misleading, or incomplete information.
- Publish content that is offensive, discriminatory, abusive, illegal, or incites violence.
- Infringe third-party intellectual property or privacy rights.
- Send spam, unsolicited commercial messages, or collect data from other Users without a legal basis or appropriate consent.
- Attempt to access areas or systems of the Platform without authorization, introduce malware, or circumvent security measures.
- Use the Platform for activities unrelated to recruitment or job seeking.
We may suspend or cancel the Account of any User who violates these Terms or uses the Platform abusively.
Subscriptions and paid services
Certain features of the Platform, especially for Recruiters, may be made available subject to payment of a subscription or other fees.
When the Recruiter purchases a paid plan:
- The pricing, duration, renewal, and cancellation terms will be clearly presented before purchase confirmation.
- Unless otherwise stated, paid fees are non-refundable once the subscription period has started.
- Failure to pay may result in the suspension or limitation of features associated with the subscription.
Payment obligations do not affect consumer rights guaranteed by law, where applicable.
Personal data and privacy
The processing of personal data within the Platform is governed by our Privacy Policy, which forms an integral part of these Terms.
To the extent required by applicable data protection law, we undertake to:
- Process personal data lawfully, fairly, and transparently.
- Limit processing to the purposes described in the Privacy Policy, including recruitment, operation of the Platform, security, statistics, and, where applicable, marketing with consent.
- Implement appropriate technical and organizational measures to protect data against unauthorized access, alteration, or disclosure.
The User has the rights provided by applicable law, including access, rectification, erasure, restriction, objection, and portability, which may be exercised according to the instructions in the Privacy Policy.
Platform intellectual property
All rights in the Platform and its components, including software, design, logos, trademarks, generic text, and original content, belong to European Medical Jobs or its licensors.
It is prohibited to copy, modify, distribute, sell, or exploit any part of the Platform without prior written authorization, except where permitted by applicable law.
Disclaimer and limitations of liability
The Platform acts as an intermediary between Candidates and Recruiters and does not participate in hiring decisions, working conditions, or contract negotiations.
We do not guarantee that:
- A Candidate will obtain employment or interviews through the Platform.
- A vacancy will be filled or that a Candidate has the exact qualifications stated in their profile.
- Information provided by Candidates or Recruiters is always accurate, complete, or up to date.
To the fullest extent permitted by law, our total liability arising from use of the Platform is limited to the total amount paid by the User for paid services in the 12 months preceding the event giving rise to liability.
Nothing in these Terms excludes or limits liabilities that cannot be excluded or limited under applicable law.
Account closure and suspension of services
The User may close their Account at any time through the account settings or by contacting us.
We may suspend or close the Account, in whole or in part, if:
- There are reasonable indications of a breach of these Terms or applicable law.
- There is suspicion of fraudulent or abusive use, or use that puts the security of the Platform or other Users at risk.
- It is necessary to do so to comply with legal obligations or orders from competent authorities.
Where technically feasible and legally permitted, we will notify the User before suspension or closure, stating the main reasons.
Changes to the terms
We may update these Terms to reflect legal, product, or business changes.
Whenever we make material changes, we will seek to inform Users, for example through a notice on the Platform or by email, indicating the effective date.
Continued use of the Platform after that date means acceptance of the updated Terms.
Applicable law and dispute resolution
The applicable law and competent forum may vary depending on the entity operating the Platform and the User’s country; this information will be indicated in the local version of these Terms or in the contact information.
Nothing in these Terms affects any rights the User may have as a consumer under applicable consumer protection law in their jurisdiction.
